The following memorandum of understanding is informal and is not legally binding. It is meant to provide some basic guidelines and expectations. The agreement may be dissolved at any time by the property owner or Green Noise LLC.
There are three types of “partnerships” –
Manage an Existing Tree or Trees
The property owner gives permission for Green Noise to prune mulberry branches of selected trees during the months of May and October to feed silkworm colonies. Owners agree not to apply any herbicides or pesticides directly on the trees or within 30 feet of tree leaves or roots. Green Noise will notify owners prior to pruning, will enter property based on owner’s instructions and only with permission from the owner; Green Noise LLC also agrees to limit pruning to only what is needed to maintain tree aesthetics and tree health.
Plant New Tree or Trees
The property owner gives permission for Green Noise LLC to plant new trees on the property. Owners agree to let Green Noise manage the branches and foliage of the trees. If for any reason the trees need to be removed, the property owners will give Green Noise reasonable advance notice (about 10 business days) before they are removed. The property owner is not liable for any damage or injury to the trees and the tree will remain the property of the property owner for as long as it grows on the owner’s property.
Plant Young Trees for a Nursery
The property owner gives permission for Green Noise LLC to temporarily plant and transplant new trees in a designated space on the property as a nursery. If for any reason the trees need to be removed, the property owner(s) will give Green Noise reasonable advance notice (about 10 business days) before removing them. The property owner is not liable for any damage or injury to the nursery trees and the trees will remain on the property only for temporary storage until they can be placed in a different more permanent location.
